Main Notes

1 This Chapter does not cover meat, meat offal, fish, crustaceans, molluscs or other aquatic invertebrates, as well as insects, prepared or preserved by the processes specified in Chapter 2 or 3, Note 6 to Chapter 4 or in heading 0504.

2 Food preparations fall in this Chapter provided that they contain more than 20% by weight of sausage, meat, meat offal, blood, insect, fish, crustaceans, molluscs or other aquatic invertebrates, or any combinationthereof. In cases where the preparation containstwo or more of the products mentioned above, it is classified in the heading of Chapter 16 corresponding to the component or components which predominate by weight.These provisions do not apply to the stuffed products of heading 1902 or to the preparations of heading 2103or 2104.

Sub-Heading Notes

1 For the purposes of sub-heading 1602 10, the expression "homogenised preparations" means preparations of meat, meat offal, blood or insects, finely homogenised, put up for retail sale as food suitable for infantsor young children or for dietetic purposes, in containers of net weight content not exceeding 250 g. For theapplication of this definition no account is to be taken of small quantities of any ingredients which may havebeen added to the preparation for seasoning, preservation or other purposes. These preparations may contain a small quantity of visible pieces of meat or meat offal or insects. This sub-heading takes precedence over all other sub-headings of heading 1602.

2 The fish, crustaceans molluscs and other aquatic invertebrates specified in the sub-headings of heading 1604 or 1605 under their common names only, are of the same species as those mentioned in Chapter 3 under the same name.

Policy Conditions

i. Specified Meat and meat products shall be allowed to be exported as Halal certified to the countries listed below, only if such products are produced or processed and/or packaged in a facility certified under the “India Conformity Assessment Scheme(I-CAS)- Halal” of the Quality Council of India (QCI).

ii. After the shipment(s) are made, the exporter shall provide valid Halal Certificate(s) issued under I-CAS by a Certification Body accredited by the National Accreditation Board for Certification Bodies (NABCB) to the buyer in the importing country listed below.

iii. In addition to the requisite conformity with I-CAS, the export of specified meat and meat products to countries wherein regulation(s) for import of Halal products are notified, the producer/supplier/exporter shall also meet the importing country’s requirements and regulations, as applicable, and shall provide valid certificate(s) to the buyer in the importing country issued by Halal Certification Bodies approved under the National Halal system of the Importing Country.

iv. The Policy Conditions and Procedures thereof for the Export of Non-Halal Certified Meat and Meat products remain unchanged.

v. The List of Countries wherein the above-mentioned conditions for Export of specified Halal Meat & Meat products is mandated is as follows -

(ii) After the shipment is made, the exporter shall also provide a ‘Health Certificate’ consignment-wise to the buyer giving details of the product with HS Code, packaging, its origin, destination, vessel name, date of departure, health requirements, etc. This Health Certificate would be issued jointly by CAPEXIL and Regional Animal Quarantine Officer, Department of Animal Husbandary, Dairying and Fisheries, Ministry of Agriculture and Farmers Welfare, Government of India.

Policy Conditions

1. Exports of All wild animals, animal articles including their products and derivatives excluding those for which ownership certificates have been granted and also those required for transactions for education, scientific research and management under Wild Life (Protection) Act, 1972 including their parts and products are Prohibited and not permitted to be exported
