SCHEDULE 1 – IMPORT POLICY

CHAPTER 88
AIRCRAFT, SPACECRAFT AND PARTS THEREOF

NOTE:

1. For the purposes of this Chapter, the expression “unmanned aircraft” means any aircraft, other than those of heading 8801, designed to be flown without a pilot on board. They may be designed to carry a payload or equipped with permanently integrated digital cameras or other equipment which would enable them to perform utilitarian functions during their flight.

The expression “unmanned aircraft”, however, does not cover flying toys, designed solely for amusement purposes (heading 9503)

Sub-heading Notes:

1. For the purposes of sub-headings 8802 11 to 8802 40, the expression “unladen weight” means the weight of the machine in normal flying order, excluding the weight of the crew and of fuel and equipment other than permanently fitted items of equipment.

2. For the purposes of sub-headings 8806 21 to 8806 24 and 8806 91 to 8806 94, the expression "maximum take-off weight" means the maximum weight of the machine in normal flying order, at take-off, including the weight of payload, equipment and fuel.’

Policy Conditions to this Chapter:

1. Aircraft and Helicopters (including used/second hand aircraft and helicopters) may be imported by the following without the need to obtain an import license from Directorate General of Foreign Trade.

(a) Air India

(b) Pawan Hans Limited

(c) Airports Authority of India

(d) Indira Gandhi Rashtriya Uran Academi (IGRUA)/and such other flying clubs/ Academies recognised by the Ministry of Civil Aviation, Government of India

(e) International Financial Leasing Centre (IFSC) based Aircraft Leasing Entity

(f) Any person/entity who has been granted NOC for import of aircraft/helicopters by DGCA, for undertaking Scheduled/Scheduled Commuter/ Non-Scheduled Air Transport Services or Aerial Work operations

2. The import of aircraft by any other category of importers shall require an import licence to be granted by this Directorate

3. 1. Import of drones in Completely-Built-Up (CBU), Semi-knocked-down (SKD) or Completely-Knocked-down (CKD) form is Prohibited, with following exceptions: -

i. Import of drones by Government entities, educational institutions recognized by central or state government, government recognized R&D entities and drone manufacturers for R&D purpose shall be allowed in CBU, SKD or CKD form subject to import authorisation issued by DGFT in consultation with concerned line ministries.

ii. Import of drones for defence & security purposes shall be allowed in CBU, SKD or CKD form subject to import authorisation issued by DGFT in consultation with concerned line ministries.

2. Import of drone components shall be ‘Free’.
