Import of crushed and de-oiled GM soya cake - Relaxation in applicability of provision in Para 6 (b) of General Notes Regarding Import Policy Schedule - I (Imports) of the ITC(HS) 2017, Schedule I(Import Policy)-reg-

Kind reference is invited to DGFT's Notification No. 20/2015-2020, dated 24.08.2021, amended further by Notification No. 23/2015-2020, dated 03.09.2021, Notification No. 25/2015-2020 dated 13.09.2021, Notification No. 32/2015-2020 dated 25.09.2021 and Notification No. 3612015-2020 dated 08.10.2021 and CBIC's instructions dated 28.08.2021, 04.09.2021, 25.09.2021 and 12.10.2021 (copies of the said Notifications and Instructions enclosed)

2. As per the the above said Notifications and Board Instructions:

(i) The Central Government has relaxed the provision in Para 6 of General Notes Regarding Import Policy, Schedule — I (Imports) of the ITC(HS), 2017. Accordingly, Condition No. 6 (b) of General Notes Regarding Import Policy Schedule -I (Imports) of the ITC (HS) 2017 will not apply to import of 12 Lakh Metric ton of crushed and de-oiled GM soya cake (only Non-living organism).

(ii) The subject goods are classifiable under ITC HS codes 23040020 and 23040030.

(ii) The above mentioned import is allowed only through Nhava Sheva Sea Port (INNSA1) , LCS Petrapole (INPTPB), Mumbai Sea Port (INBOM1), Tuticorin Sea Port (INTUT1), Vishakhapatnam Sea Port (INVTZ1), Ghojadanga LCS (INGJXB), Kolkata Port (INCCU1) and Ranaghat Railway Station (INRNG2), till 31st October, 2021 or until further orders, whichever is earlier.

3. Further, vide Notification No. 25/2015-2020 dated 13.09.2021, DGFT has amended the last date of import i.e. 31st October 2021 in Para 3 of Notification No. 2012015-20 dated 24.08.2021 to read as "the last date of shipment or the Bill of Lading date (in case of permitted Seaports) or Lorry Receipt date (in case of LCS Petrapole) shall be 31.10.2021 or until further orders, whichever is earlier. Further, import consignments of these items with Bill of Lading/Lorry Receipt issued on or before 31st October, 2021 shall not be allowed by Customs beyond 31st January 2022."

4. To facilitate the identification of crushed and de-oiled GM Soya cake, necessary changes have been made in the Bill of Entry format for ITC HS Codes 23040020 and 23040030, to declare the GM status (i.e genetically modified or not) and grade of the product (i.e.Fit for Human or Animal consumption).

5. Considering the quantity, port and time restriction on import of the subject goods, the daily quantum of clearance of the above product is being published on the CBIC website (https://www.cbic.gov.in/htdocs-cbec/home_links/imp-soya) for the benefit and convenience of the Importers. The Importers may be accordingly sensitised about the above facility for planning their Imports in advance, given the quantitative, port and time restrictions in force.

6. Suitable Public Notices for guidance of Importers and trade and orders for officers for sensitising them, may be issued. Difficulty, if any, may be brought to the notice of the Board.

Subject: Relaxation in applicability of provision in Para 6 (h) of General Notes Regarding Import Policy Schedule - I (Imports) of the ITC(HS) 2017, Schedule - I (Import Policy).

S.O. 3464(E).—The following communications have been received regarding the import of crushed and de-oiled GM soya cake (Non-living organism only):

1 (i) Vide DO No. R-43011/2/2021-Anim_Dadf dated 27.7.2021, Ministry of Fisheries. Animal Husbandry & Dairying sought permission/approval of MOEF&CC for allowing import of 12 Lakh MT crushed and de-oiled GM soya cake (Non-living organism) upto 31st October 2021. or earlier; 
(ii) In response to the above, MOEF vide OM dated 6.8.2021. has clarified that, "Since soya de-oiled and crushed (I)OC) cake does not contain any living modified organism, this Ministry has no concerns and no objection for import of soya cakes from environmental angle":
(iii) DoCA vide F. No. M-1/1/2020-PMC dated 16.8.2021 and Corrigendum dated 16.8.2021 has conveyed the approval of the Competent Authority to facilitate the import of 12 Lakh ton of GM soya de-
oiled cake: and
(iv) DAHD vide letter dated 19.8.2021 has communicated those imports may be facilitated at 2 ports namely, Nhava Sheva (sea port) and Petrapole border (land port);

2. Therefore, in exercise of powers conferred by Section 3 read with Section 5 of FT(D&R) Act, 1992 and paragraph 1.02 and 2.01 of the Foreign Trade Policy, 2015-2020, as amended from time to time, the Central Government hereby relaxes the provision in Pant 6 of General Notes Regarding Import Policy. Schedule — I (Imports) of the ITC(HS). 2017.

3. Accordingly. Condition No. 6 (b) of General Notes Regarding Import Policy Schedule -I (Imports) of the ITC (171S) 2017 will not apply to the import of 12 Lakh Metric ton of crushed and de-oiled GM soya cake (only Non-living organism) under ITC HS codes 23040020 and 23040030 till 31' October,2021 or until further orders, whichever is earlier. only from Nhava Sheva (INNSAI) port and LCS Petrapole (1NPTPB).

4. Strict monitoring of import quantity of the above items through the designated ports shall be carried out by CRIC through the customs authorities at the respective ports to ensure that the quantity of 12 lakh Metric ton is not breached.

Effect of the Notification: Application of provision as in Condition 6(b) of General Notes Regarding Import Policy Schedule — I (Imports) of the ITC (HS) 2017 is relaxed to allow imports of 12 Lakh Metric ton of crushed and de-oiled GM soya cake (only Non-living organism) under ITC IIS codes 23040020 and 23040030 from Nhava Sheva (INNSA1) port and LCS Petrapolc (INPTPB). till 31st October. 2021 or until
further orders, whichever is earlier.

This issues with the approval of the Minister of Commerce & Industry.

S.O. 3708(E).—In exercise of powers conferred by Section 3 read with Section 5 of FT (D&R) Act, 1992 and paragraph 1.02 and 2.01 of the Foreign Trade Policy, 2015-2020, as amended from time to time, the Central Government hereby amends the provision in Para 3 of Notification No. 20/2015-20 dated 24.08.2021 as under:-

The last date of import, 31.10.2021, as mentioned in Para 3 of Notification number 20 dated 24.8.2021, is amended to read as " Last date of shipment or Bill of Lading date ( in case of permitted seaports) or Lorry Receipt date ( in case of LCS Petrapole)" shall be 31.10.2021 or until further orders, whichever is earlier. 2. It is stated that vide the above -mentioned Notification, DGFT has relaxed the provision in Para 6 of General Notes Regarding Import Policy, Schedule — I (Imports) of the ITC(HS), 2017 for facilitating the import of 12 Lakh Metric tons of crushed and de-oiled GM soya cake (only Non-living organism) under ITC HS codes 23040020 and 23040030 till 31st October,2021 only through Nhava Sheva (INNSA1) port and LCS Petrapole (INPTPB).

3. With regard to monitoring of the quantities, CBIC has already taken up the issue with DGFT vide O.M. No. 401/54/2021-Cus.III dated 19.08.2021 (copy enclosed) and the procedure in that regard is yet to be finalised. However, in the interest of urgent requirement in the domestic market, the subject goods may be allowed to be cleared as per the above relaxation and quantity cleared may be monitored and reported to the Board on a daily basis as per proforma in Annexure -I.

4. Further, it is informed that, FSSAI vide letter F.No.I-1691/FSSAI/Imports/2017- Misc.issues dated 4.08.2021(copy enclosed), has conveyed that since this particular import commodity, (GM soya de-oiled cake) is not consumed by humans, the same would not come under the purview of Food Safety and Standards Authority of India (FSSAI).

5. In this regard, to distinguish other Non-GM commodities or ones fit for human consumption, this office has already taken up the issue with DG Systems and NCTC vide O.M. No. 401/54/2021-Cus.III dated 26.08.2021(copy enclosed) for mandatorily seeking additional details such as Food/Pharma/Non-Food grade and GM Status of such product from the importer in the Bill of Entry for effective monitoring of import through the Risk Management System. These changes are likely to be introduced soon for proper monitoring and facilitation.

6. Board desires that the concerned officers in your jurisdiction maybe immediately and suitably sensitised about the above-mentioned changes and ensure that the import of consignments of crushed and de-oiled GM soya cake (only Non-living organism) are facilitated expeditiously.

Tuticorin Sea Port (INTUTI) and Visakhapatnam Sea Port (1NVTZl).

No. 401.54 2021-Cus.III dated 19.08.2021 (copy enclosed) and the procedure in that regard is vet to be finalised. Schedule — I (Imports) of the ITC(HS), 2017 for facilitating the import of 12 Lakh Metric tons of crushed and de-oiled GM soya cake (only Non-living organism) under ITC HS codes 23040020 and 23040030 till 31st October, 2021 only through Nhava Shex a (INNSAI ) port. LCS Petrapole (INPTPB). Mumbai Sea Port (INBOM1), Tuticorin Sea Port (INTUT1). Visakhapatnam Sea Port (INVTZ1 ), Ghojadanga LCS (INGJXB). Kolkata Port (1NCCUI) and Ranaghat Railway Station (INRNG2).

3. Ranaghat Railway Station has been added vide Notification No 36,2015-2020 dated 8th October. 2021 for for allowing imports under Notification No. 20/2015-20 dated 24.08.2021. Further, necessary changes have been made in ICEGATE wherein importers can specify whether the items imported under ITC HS Codes 23040020 and 23040030 are genetically modified or not. In this regard, Customs officers are requested to ensure that importers importing soya under the subject HS Codes specify the GM status in ICEGATE.

4. Board desires that the concerned officers in your jurisdiction maybe immediately and suitably sensitised about the above-mentioned changes and ensure that the import of consignments of crushed and de-oiled GM soya cake (only Non-living organism) are facilitated expeditiously. The subject goods may be allowed to be cleared as per the above relaxation and quantity cleared may be monitored and reported to the Board on a daily basis as per proforma in Annexure -1.
