1. The present petition has been filed by the petitioner being aggrieved by the inaction on the part of respondent no. 1 in granting renewal of the petitioner’s recognition as a Pre-Shipment Inspection Agency (PSIA).

2. The case of the petitioner is that it was duly recognized as a PSIA upon completion of all formalities and pursuant to execution of a bank guarantee. The said recognition was publicly announced on 09.06.2022.

3. The petitioner participated in the renewal cycle and to ensure uninterrupted recognition, the petitioner took proactive steps by allowing the bank guarantee to be renewed. Further, before expiry of its recognition on 08.06.2025, the petitioner addressed a renewal request on 25.04.2025 enclosing all required documents.

4. Importantly, in the minutes of the 27th meeting of the Inter-Ministerial Committee (IMC), dated 25.06.2025, which was held to consider applications for recognition as Pre-Shipment Inspection Agency (PSIA), the following has been noted with regard to the petitioner:

5. Thus, it appears that the aforesaid committee has decided to approve the renewal, subject to the petitioner’s submitting a valid bank guarantee.

6. As such, there is no justification for the respondent no.1 for not taking an appropriate decision on the petitioner’s renewal application dated 09.05.2025 under Ref. No. DRAFTPSIAAPPLY01206474AM26.

7. In the circumstances, the petition is disposed of with a direction to the respondent no.1 to process the aforesaid renewal application in accordance with law and take an appropriate decision thereon under intimation to the petitioner.

8. Let the same be done within a period of six weeks from today.
